Question

Often times, when I do instinjah, I feel like the water is spilling back on me. What is the ruling on the water that spills on one who uses a modern toilet, when washing oneself. Is the water from his toilet that spills after one relieved oneself najis? How to deal with that?

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.

The water that splashes onto a person whilst relieving himself in a modern toilet is Najis (impure). A person should take precaution and save himself from water splashing onto him by putting toilet paper into the pan etc. However, if this impure water does splash onto him, there is no need to have a gusul, only the soiled area will have to be washed.

It is mentioned in a Hadeeth that one of the causes for a person to be punished in the grave is, not to be careful of urine droplets whilst relieving oneself.[1]

[1] قال حدثنا الأعمش عن مجاهد عن طاوس عن ابن عباس قال مر النبي صلى الله عليه وسلم بقبرين فقال إنهما ليعذبان وما يعذبان في كبير أما أحدهما فكان لا يستتر من البول وأما الآخر فكان يمشي بالنميمة ثم أخذ جريدة رطبة فشقها نصفين فغرز في كل قبر واحدة قالوا يا رسول الله لم فعلت هذا قال لعله يخفف عنهما ما لم ييبسا قال ابن المثنى وحدثنا وكيع قال حدثنا الأعمش قال سمعت مجاهدا مثله يستتر من بوله (متفق عليه)
