KINDLY DO INFORM ME AS TO HOW A PERSON MUST MANTAIN TWO WIVES INJ THE FOLLOWING INSTANCES

(1)WHEN HE GETS MARRIED TO THE SECOND WIFE HE PAYS HER DOWRY,ORGANIZES A SMALL FLAT AND FURNISHES WITH THE BASICS EXAMPLE BED,STOVE ETC DOES HE HAVE TO GIVE THE 1ST WIFE THE EQUIVALINT OF THE THE ABOVE MENTIONED ITEMS IN CASH OR NOT?

(2)A PERSONS 1ST WIFE HAS THREE CHILDREN WITH HIM (SHE IS STILL MARRIED TO HIM) WHEN HE GIVES MAINTENANCE ON A MONTHLY BASIS DOES HE GIVE THE SAME AMOUNT TO THE SECOND WIFE THAT HE WILL GIVE TO THE FIRST WIFE? EXAMPLE MONTHLY HE GIVES THE 1ST WIFE R2000-00 FOR THEIR NEEDS AS WELL AS THAT OF THE CHILDREN DOES HE GIVE THE SECOND WIFE THE SAME AMOUNT?

(3)HOW DOES ONE STRUCTURE AN ISLAMIC WILL FOR MINORS (UNDER 18) SINCE SOME OF THEM ARE GIVEN HUGE AMOUNTS OF MONEY AS GIFTS .IF SUCH A CHILD PASSES AWAY BECAUSE HE IS UNDER 18 HE CAN NOT DRAW UP HIS OWN WILL WHAT IS THE SOLUTION?

(4) I HIRE A BUILDING TO A TENANT FOR A PERIOD OF TEN YEARS.THE LEASE IS AGREED AND SIGNED.AFTER THREE YEARS THE TENANT BREACHES THE LEASE ON THE GROUNDS THAT BUSINESS IS BAD HOWEVER HE OPENS ANOTHER BRANCH IN THE SAME TOWN AT A DIFFERENT LOCALITY. – WHILE I CAN TAKE HIM TO COURT LEGALY HE WANTS TO SETTLE MATTERS OUT OF COURT WHEREBY HE IS PREPEARD TO PAY ME THE EQUIVALANT OF THREE YEARS RENTAL . IS THIS SETLLEMENT PERMISSIBLE AND CAN I USE THIS MONEY?

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.

 

1. According to Shariah, a husband will have to maintain equality among his wives in the issue of spending the number of nights with each wife. According to the preferred opinion of the Fuqahaa (jurists), it is not necessary for the husband to maintain financial equality among his wives. The husband is required to support each wife according to her individual living standard at the time of his Nikah to her.

أَمَّا عَلَى الْقَوْلِ الْمُفْتَى بِهِ مِنْ اعْتِبَارِ حَالِهِمَا فَلَا فَإِنَّ إحْدَاهُمَا قَدْ تَكُونُ غَنِيَّةً وَالْأُخْرَى فَقِيرَةً ، فَلَا يَلْزَمُ التَّسْوِيَةُ بَيْنَهُمَا مُطْلَقًا فِي النَّفَقَةِ

المبسوط – (ج 4 / ص 103(

فنقول إذا كان للرجل الحر أو المملوك امرأتان حرتان فإنه يكون عند كل واحدة منهما يوما وليلة وإن شاء أن يجعل لكل واحدة منهما ثلاثة أيام فعل لأن المستحق عليه التسوية فأما في مقدار الدور فالاختيار إليه وهذه التسوية في البيتوتة عندها للصحبة والمؤانسة لا في المجامعة لأن ذلك ينبني على النشاط ولا يقدر على اعتبار المساواة فيه فهو نظير المحبة في القلب

2. The expenses for the children are separate and cannot be included into the wife’s share.

3. According to Shariah, when a person becomes physically mature or reaches the age of 15 he/she is considered as an adult. An 18 year old teen will structure his/her will just like an adult. If he/she wishes to bequeath any portion of his/her money, they may do so. The money will be distributed according to the Shariah Laws of Inheritance.

4. According to Shariah, if the tenant has a valid Shar’ie reason to cancel the Ijaarah contract (lease agreement), he may do so. The Fuqahaa consider liquidation, bankruptcy, lack of funds valid excuses for the early termination of a lease. Therefore if your tenant claims that he cannot meet the rental payments and wishes to cancel, he will have the Shar’ie right to do so. The owner claiming future rentals and damages is against Shariah. Any amounts received from the legal claim of future rentals, damages etc. will not be considered to be Halaal.

The Landlord will have the right to investigate and verify the excuse presented by the tenant.

الَ رَحِمَهُ اللَّهُ ( وَتُفْسَخُ بِالْعُذْرِ وَهُوَ عَجْزُ أَحَدِ الْعَاقِدَيْنِ عَنْ الْمُضِيِّ فِي مُوجِبِهِ إلَّا بِتَحَمُّلِ ضَرَرٍ زَائِدٍ لَمْ يَسْتَحِقَّ بِهِ كَمَنْ اسْتَأْجَرَ رَجُلًا لِيَقْلَعَ ضِرْسَهُ فَسَكَنَ الْوَجَعُ ) يَعْنِي تُفْسَخُ الْإِجَارَةُ بِالْعُذْرِ الَّذِي هُوَ الْعَجْزُ عَنْ الْمُضِيِّ فِي مُوجِبِ الْعَقْدِ إلَّا بِتَحَمُّلِ ضَرَرٍ زَائِدٍ لَمْ يُسْتَحَقَّ بِالْعَقْدِ أَيْ بِنَفْسِ الْعَقْدِ كَمَنْ اسْتَأْجَرَ إلَخْ
