Answer

Muhtaram / Muhtaramah

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.

1. It was the sunna of the Prophet (sallallaahu alayhi wa sallam) to sleep with his wives. Consider the following ahadith:

عن ميمونة: أن رسول الله صلى الله عليه و سلم كان يباشر المرأة من نسائه وهي حائض إذا كان عليها إزار إلى أنصاف الفخذين أو الركبتين تحتجز به

“Maymoonah (radiyallaahu anhu) narrates that the Prophet (sallallaahu alayhi wa sallam) would sleep with his wife during her menses provided the area up to the knees were covered.” (Abu Dawood, pg 35, vol 1, HM Sa’eed)

قال سمعت عائشة رضي الله عنها تقول: كنت أنا ورسول الله صلى الله عليه و سلم نبيت في الشعار الواحد وأنا حائض طامث

“Ayesha (radiyallahu anhu) narrates that the Prophet (sallallaahu alayhi wa sallam) and I would sleep under one sheet whilst I was in menses” (ibid)

2. As a principle, if the nappy of the child did not soil the garment of the musalli (one performing salat), the salat will be valid. However, if the nappy soiled the garment, then one should determine the extent of the impurity. If the extent of the impurity was such that it does not permit salat( approximately three centimeters in diameter or more than four grams in weight), the salat will be invalid. If the extent of the impurity was lesser, the salat will be valid.( Behishti Zewar, vol 1, pg 40)

3. If during the eid salat the Imaam forgot to make the six extra takbeers and did not make sajdah sahw, then ruling will be according to the following two situations:

  • If there is such a large crowd that by the Imaam making sajdah sahw confusion would be created then in this situation it will not be necessary to make sajdah sahw and the eid salat would be valid.
  • If there is no fear of confusion then sajdah sahw should be made. If the sajdah sahw was not made, it will be wajib to repeat the eid salat. However, if the time of eid salat has gone out, there will be no need to repeat the salat. )Fatawaa Darul Uloom Deoband, vol 5, pg 204 /Fatawaa Raheemiyya, vol 5, pg 194 / Ahsan Al-Fatawaa, vol 4, pg 47 / Fatawaa Al-Kamiliyya, pg 13 / Fatawaa Al-Mahmudiyya, vol 7, pg 461, Faruqiyya)

4. If the masbooq mistakenly makes salaam with the Imaam, then there is no need to make sajdah sahw. However, if the masbooq made salaam after the salaam of the Imaam, sajdah sahw will have to be made. If sajdah sahw was not made, it will be waajib to repeat the salat. However, very seldom it happens that the masbooq’s salaam is simultaneous with the salaam of the Imaam. (Fatawaa Raheemiyya, vol 5, pg 192 / Ahsan Al-Fatawaa, vol 4, pg 47
