IS IT PERMISSIBLE FOR A HANAFI MUQEEM TO PERFORM HIS ASR SALAAH
Question
IS IT PERMISSIBLE FOR A HANAFI MUQEEM TO PERFORM HIS ASR SALAAH,ONCE THE SHAFI ASR TIME HAS ENTERED AND WHILST IT IS STILL ZUHR TIME ACCORDING TO YHE HANAFI’s?
Answer
Muhtaram / Muhtaramah
In the Name of Allāh, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.
There two views within the Hanafi Madhhab regarding the time of ‘Asr. The first view is that of Imam Abu Hanifa (rahimahullah) that states that ‘Asr commences in Mithal al-Thani (when the shadow of an object reaches twice its own height excluding the existing shadow at the time of Zawwal). The second view is that of Imam Abu Yusuf and Imam Muhammad, commonly referred to as Sahibayn that states that ‘Asr commences in Mitahl al-Awwal (when the shadow of an object equals its own height excluding the existing shadow at the time of Zawwal). Both views are well substantiated and jurists within the Hanafi Madhhab have given preference to both views. However, considering the fact that we are muqallids of Imam Abu Hanifa (rahimahullah) and the fact that it is more precautious to perform ‘Asr in Mithal al-Thani, we will follow Imam Abu Hanifa’s view. (Fatawa Dar al-Uloom Deoband, vol. 1 pg. 196-197, Dar al-Isha’at)
Nevertheless, if there is a genuine need to move away from his view such as being on a journey or being in one of the Haramayn etc, it will be permissible to act upon the view of Sahibayn and perform ‘Asr in Mithal al-Awwal. Furthermore, one should not make a habit of continually performing ‘Asr in this time as it would outwardly seem as if the person is abandoning the view of Imam Abu Hanifa (rahimahullah). (Fatawa Mahmoodiyah, vol. 5 pg. 338, Jamia Farooqiya)
