Is it allowed to have an abortion if you were raped?

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.


Allah, The Most Merciful, has created mankind and out of His wisdom has stipulated laws to govern them.  The laws of Shari’a are such that different needs and conditions of people are kept into consideration in such a manner that no person becomes an oppressor or an oppressed.

In the natural disposition of a woman, the most sacred and beloved thing to her is her chastity.  Throughout her life, Shari’a encourages her to adopt modesty in all situations and safeguard her chastity.  The greatest oppression that can be done upon her is to forcibly snatch this chastity away and rape her, thus destroying that which is so dear to her for which she worked her entire life to protect.

Rape is an act done against a woman’s will.  The psychological damage on her is difficult to bear.  Shari’a does not hold her responsible if she falls pregnant through this horrendous act.

The Jurists have explained that if there is a legitimate excuse for abortion, then it will be permissible to abort the fetus on condition the fetus has not developed the physical features such as the eyes, hand, feet, etc. and the soul has not entered into the fetus.  The period for this is 120 days.

If the fetus is 120 days, then it will not be permissible to abort the child, since it has life in it and will be regarded as a human being.  To abort the child would equal to murdering a human being.  Conceiving a child through rape does not justify and permit murdering the child.

It is possible for a woman to determine her pregnancy well before the elapse of 4 months.  If she desires to abort the child, it should be done before this period.  If she aborts upon 120 days, she will be sinful for murdering a human being.

It should also be noted that this admissibility of abortion before 120 is only when there is a legitimate excuse.  In normal circumstances, abortion is strictly prohibited in Shari’a regardless if it is before 120 days or after.  The Shari’ee validity of abortion should be presented to a competent Mufti for a fatwa.

– وَلَا تَقْتُلُوا أَوْلَادَكُمْ خَشْيَةَ إِمْلَاقٍ نَحْنُ نَرْزُقُهُمْ وَإِيَّاكُمْ إِنَّ قَتْلَهُمْ كَانَ خِطْئًا كَبِيرً – (الاسراء 31)

مطلب في حكم إسقاط الحمل ( قوله وقالوا إلخ ) قال في النهر : بقي هل يباح الإسقاط بعد الحمل ؟ نعم يباح ما لم يتخلق منه شيء ولن يكون ذلك إلا بعد مائة وعشرين يوما ، وهذا يقتضي أنهم أرادوا بالتخليق نفخ الروح وإلا فهو غلط لأن التخليق يتحقق بالمشاهدة قبل هذه المدة كذا في الفتح ، وإطلاقهم يفيد عدم توقف جواز إسقاطها قبل المدة المذكورة على إذن الزوج . وفي كراهة الخانية : ولا أقول بالحل إذ المحرم لو كسر بيض الصيد ضمنه لأنه أصل الصيد فلما كان يؤاخذ بالجزاء فلا أقل من أن يلحقها إثم هنا إذا سقط بغير عذرها ا هـ قال ابن وهبان : ومن الأعذار أن ينقطع لبنها بعد ظهور الحمل وليس لأبي الصبي ما يستأجر به الظئر ويخاف هلاكه . ونقل عن الذخيرة لو أرادت الإلقاء قبل مضي زمن ينفخ فيه الروح هل يباح لها ذلك أم لا ؟ اختلفوا فيه ، وكان الفقيه علي بن موسى يقول : إنه يكره ، فإن الماء بعدما وقع في الرحم مآله الحياة فيكون له حكم الحياة كما في بيضة صيد الحرم ، ونحوه في الظهيرية قال ابن وهبان : فإباحة الإسقاط محمولة على حالة العذر ، أو أنها لا تأثم إثم القتل ا هـ . وبما في الذخيرة تبين أنهم ما أرادوا بالتحقيق إلا نفخ الروح ، وأن قاضي خان مسبوق بما مر من التفقه ، والله تعالى الموفق ا هـ كلام النهر ح .
