1.) OUR TENANT IS WITHOLDING RENT AT OUR BUSINESS PREMISES WHICH HE HAS VACATED , CITING THAT HE HAS DONE SOME RENOVATIONS AND WANTS COMPENSATION FOR SAME.
PLEASE GIVE SHARIAH RULING REGARDING THIS.
2.)THE TENANT ALSO SUBLETS PORTION OF THE PREMISES AND COLLECTS RENT.WHAT IS THE SHARIAH RULING ON RENT COLLECTED ON PORTION SUBLETTED.
- WE WILL APPRCEIATE A MUTUAL SOLUTION REGARDING THIS ISSUE.

Answer:
- If there was an agreement between landlord and tenant with regards to the renovation, the ruling will be in accordance to their agreement. In the absence of an agreement, the tenant has voluntary carried out renovations and a compensation cannot be claimed.
- It is permissible for the tenant to sublet the premises, if it does not violet the lease agreement and a higher rental cannot be charged unless improvements are made to the premises that the warrant the higher rental.
