Question:
Sheikh with regards to “unperformed salat”. Can this be part of my will & how will this be settled if I die without performing my qadha salahs?
Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
As-Salāmu ʿAlaykum Wa-Raḥmatullāhi Wa-Barakātuh
In the case under discussion, a person who has qaḍāʾ ṣalāh outstanding must make every possible effort to perform them during his lifetime.
If, however, he is unable to complete them before death, he should include in his will that fidya for the missed ṣalāhs be paid from his estate. The amount of fidya to be paid is equivalent to the value of Ṣadaqat al-Fiṭr for each missed Farḍ and Witr ṣalāh.
After his death, if the fidya amount exceeds one-third of the estate, it may only be covered with the consent of all heirs provided they are all mature. Any heir who wishes to pay the balance from personal funds is also permitted to do so. [1]
