Question
Request for Shariah Guidance Regarding Tubal Ligation for Medical Reasons
Assalamu Alaikum wa Rahmatullahi wa Barakatuh, Mufti Saheb,
Is tubal ligation permissible in Islam if a qualified gynaecologist advises that a third pregnancy could pose serious risks to the mother’s health or life? Considering the fact that any pregnancy above 40 years old is high risk.
Answer
In the Name of Allah, the Most Gracious, the Most Merciful.
As-Salāmu ‘Alaykum Wa-Rahmatullāhi Wa-Barakātuh.
Permanent sterilization through tubal ligation is generally not permissible in Islam, as it permanently terminates the ability to reproduce. However, if a reliable, pious and experienced Muslim doctor determines that a future pregnancy poses a serious risk to the mother’s life, and no suitable temporary alternative is available, then tubal ligation may be permissible due to necessity. Being over 40 years of age alone does not make tubal ligation permissible.[1]
And Allah Taʿāla Knows Best.
