Can i do Istakhara for choosing a madhab amongst 4 major madhabs?

 

Assala mu alaikum, I am a converted muslim and a student of Software engineering and also studying Islam in Detail, And now i am a bit confused about the rulings in every madhabs. To give you an example in this context – Imam shafi said that when a women touches a man who is in a state of wudhu, the wudhu of the man breaks. However, this ruling of Imam Shafi contradicts the authentic saying of the Prophet.

 

Narrated Aisha

The Prophet (may peace be upon him) kissed one of his wives and went out for saying prayer. He did not perform ablution. (Sunan Abu Dawood Vol. 1 Chapter No. 70 Hadith No. 179)

 

Thus this particular teaching of Imam Shafi contradicts the authentic saying of the Prophet.

 

Another example is in hanbali madhab that a person becomes kaafir if he do not perform salaah, And even he is not recommended to do Qaza-e-umri as there is no qaza for a kaafir but it is different in other madhabs.

 

Now could you please tell me that can i do istikhara to which madhab i have to follow? Some salafi told me that follow Qur’aan and sunnah only. But i have learned Islam to that level that i found Taqleed a necessity, BUT to which madhab i have to follow is what i am asking here. Please guide me.

By reading a few books on law or medicine one does not become a lawyer or doctor. In the same way by just reading a few books on Islam or a translation of the Ahadith one does not become a mujithid (one who is capable for deducing laws directly from Quran and Hadeeth). Unfortunately it has become the trend today that everybody wants to be a mujtahid. You should thank Allah Ta’ala for granting you the ability to understand the need of taqleed.

In choosing a madhab you should consider your surroundings. Which madhab does the people of your locality follow. The madhab of your local Alim. This will make it easier to learn your madhab and will assist you in times when you are faced with a complex situation. You could also do istikhara in choosing your madhab.
