Question

Is it still considered rape if the male didn’t ejaculate and didn’t penetrate into vagina and didn’t fully go into the anus? He realized that what he was doing was wrong and immediately stopped.

in this scenario the male was about 15 yrs. old who became baligh recently and was getting wet dreams very frequently and the girl was 8 or so while sleeping.

I would like to know if this is rape and how one should repent?

Answer

Muhtaram / Muhtaramah

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.

We acknowledge receipt of your enquiries and the response follows hereunder:

First we should understand the concept of rape.

Rape consists of a person having sexual intercourse with another person chiefly “by force” or where that sort of intercourse is also “against his/her will” –  meaning that at the relevant time consent to it had  expressly or impliedly been refused otherwise it will be zina (adultery). Rape and Zina are major sins and the punishment of stoning or lashing will apply.

Allah is Most Forgiving, you should make Tawbah (repent) sincerely and have firm intention never to repeat that sin again and adopt the fear of Allah

And Allah knows best
