Question

 

 

 

1. CAN A PERSON MAKE WASSIYAT THAT AFTER I DIE MY HOUSE BECOMES WAQF TO THE MOSQUE TRUST. WHAT A BOUT A PERSONS AUTOMATIC HEIRS?

 

 

 

Answer

 

Muhtaram / Muhtaramah

 

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāh wa-barakātuh.


A person is allowed to make wasiyyat up to 1/3 of his estate.

(Hidaya, Vol. 4, Pg. 654, Shirka)[1]

If the value of the house does not exceed 1/3 of his estate, the wasiyyat will be executed accordingly and the remainder of the estate will be distributed amongst his heirs according to the Islamic law of succession.

However, if the value of the house exceeds 1/3 of his estate but all the heirs approve the wasiyyat, it will be executed. Their approval will only be considered after his death and not during his lifetime.

[1] قال ( الوصية غير واجبة وهي مستحبة ) والقياس يأبى جوازها لأنه تمليك مضاف إلى حال زوال مالكيته…. وقد نطق به الكتاب وهو قوله تعالى { من بعد وصية يوصى بها أو دين } والسنة وهو قول النبي عليه الصلاة والسلام { إن الله تعالى تصدق عليكم بثلث أموالكم في آخر أعماركم زيادة لكم في أعمالكم تضعونها حيث شئتم } أو قال { حيث أحببتم } وعليه إجماع الأمة .ثم تصح للأجنبي في الثلث من غير إجازة الورثة لما روينا ، وسنبين ما هو الأفضل إن شاء الله تعالى . قال ( ولا تجوز بما زاد على الثلث )
